On April 16, 2019 Colorado Governor Polis signed SB 19-181, a bill which states that the Colorado Oil and Gas Conservation Commission (COGCC) must protect public health and the environment from oil and gas development. This bill affirms the legal arguments made by the seven youth plaintiffs in their lawsuit, Martinez v. COGCC, and gives local elected officials more control over oil and gas operations, directly presenting Coloradans, including youth, the opportunity to have their voices heard. Although the youth plaintiffs celebrate this victory, the fight is not over yet. SB 19-181 orders the COGCC to protect public health and the environment, but does not explain how. As the Martinez plaintiffs have shown, young people have the power to hold the government accountable. It’s time now to hold the COGCC accountable to its mandate to protect public health, safety, and welfare by ensuring that the COGCC promulgate strong rules that address the impacts of Colorado’s pervasive and dangerous oil and gas development on public health and its contributions to climate change.
